Objective and Applicability of the Minimum Wages Act, 1948 – The main purpose of the Minimum Wages Act, 1948 is to fix the minimum rate of wages for particular sector of work. Minimum wages is fixed on mainly basic and dearness allowance.
Fixation of Working Hours and Overtime – One day rest is compulsory after 7 days of work. Overtime rate is fixed as double the ordinary rate of wages. The “Appropriate Government” fixes the minimum wages and it is published through a notification.
Payment of Minimum Wages – The employer must not pay less than the prescribed minimum wages as per the notification.
Filing of Dispute/ Claim by an Employee – An aggrieved employee getting less than the prescribed minimum wages from his employer can raise the dispute before the appropriate authority and can also claim up to 10 times compensation from the employer.
Penal Provisions – If an employer pays less than the prescribed minimum wages or violates the provisions for fixing of working hours as prescribed under the Minimum Wages Act, 1948, then he may face imprisonment up to 6 months or fine up to Rs.500/-.
