The Employees’ State Insurance Corporation having its head office at Kolkata is a statutory body created under the beneficial legislature of the ESI Act, 1948. The ESI Corporation after covering a company Under Section 2(12) of the ESI Act and calculating the contributions thereof gives the company an opportunity of being heard before passing final order Under Section 45A of the ESI Act. Once an order is passed Under Section 45A of the ESI Act, 1948 the said order can be challenged before the Appellate Authority Under Section 45AA of the ESI Act, 1948 or can be directly challenged before the Learned Judge, EI Court, Kolkata Under Section 75 of the ESI Act, 1948.
